Welcome to Shared Saddle. These Terms & Conditions (“Terms”) govern your access to and use of the Shared Saddle website, marketplace, and related services (“Shared Saddle,” the “Platform,” “we,” “us,” or “our”).
By accessing or using Shared Saddle, creating an account, submitting a listing, or purchasing a paid service, you agree to these Terms. If you do not agree to these Terms, please do not use Shared Saddle.
1. About Shared Saddle
Shared Saddle is an online marketplace designed to help horse owners and riders connect regarding shareboarding, leasing, and similar horse-related opportunities.
Shared Saddle is a connection platform only.
Unless expressly stated otherwise, Shared Saddle:
- Does not own, lease, manage, train, inspect, or supervise horses listed on the Platform.
- Does not employ, manage, certify, or supervise horse owners, riders, trainers, barn owners, or other users.
- Is not a party to any lease, shareboard, riding, boarding, training, or other agreement entered into between users.
- Does not guarantee the accuracy, safety, legality, quality, availability, suitability, temperament, training, health, experience, or condition of any horse, rider, facility, equipment, listing, or opportunity.
- Does not guarantee that any user will find a suitable horse, rider, shareboarder, lessee, lessor, or other match.
Any arrangement made between users is solely between those users.
2. Eligibility and Accounts
You must provide accurate information when creating and maintaining an account.
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- Activity conducted through your account.
- Keeping your account information reasonably current.
- Promptly notifying Shared Saddle if you believe your account has been accessed without authorization.
You may not impersonate another person, create an account using false information, or use Shared Saddle for fraudulent, deceptive, or unlawful purposes.
Users under the age of 18 should use Shared Saddle only with the involvement and permission of a parent or legal guardian. Users under 13 may not create or independently use an account.
3. Listings and User Content
Users may submit horse listings and other content, including descriptions, photographs, videos, pricing information, location information, and riding-related information.
By submitting content to Shared Saddle, you represent that:
- The information you provide is truthful and not intentionally misleading.
- You have the right to submit and display the content.
- Photographs and videos are yours or you have permission to use them.
- Your listing does not violate another person’s rights.
- Your listing complies with applicable laws and these Terms.
You remain responsible for your listings and other content.
Shared Saddle may remove, edit, restrict, reject, suspend, or decline to publish content that we reasonably believe violates these Terms, is misleading, inappropriate, fraudulent, unsafe, unlawful, outdated, or otherwise harmful to the Platform or its users.
4. License to Display User Content
You retain ownership of content you submit to Shared Saddle.
By submitting content to the Platform, you grant Shared Saddle a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and otherwise use that content as reasonably necessary to operate, promote, and improve Shared Saddle.
This license ends when the content is deleted from our active systems, except where continued retention is reasonably necessary for backups, legal compliance, dispute resolution, security, or other legitimate business purposes.
5. Listing Accuracy and Availability
Horse owners and other listing creators are responsible for keeping their listings accurate and current.
Shared Saddle does not independently verify every statement contained in a listing.
Users should independently confirm important information before entering into an arrangement, including, when applicable:
- Horse ownership or authority to offer the horse.
- Horse age, health, temperament, training, and suitability.
- Rider experience and ability.
- Boarding or barn requirements.
- Riding privileges and restrictions.
- Cost and payment arrangements.
- Insurance requirements.
- Veterinary, farrier, training, and other responsibilities.
- Scheduling and access.
- Applicable rules and expectations.
A listing appearing on Shared Saddle does not constitute an endorsement or verification by Shared Saddle.
6. Shareboard and Lease Agreements
Shared Saddle does not create, negotiate, enforce, or guarantee private agreements between users.
Users are responsible for determining whether a written agreement is appropriate and for establishing the terms of their arrangement.
Shared Saddle strongly encourages users to clearly discuss expectations before beginning a shareboard, lease, or similar arrangement and to consider using a written agreement.
Users may wish to seek independent legal, insurance, veterinary, training, or other professional advice when appropriate.
7. Horseback Riding and Equine Risk
Horseback riding, handling horses, and participating in equine-related activities involve inherent risks that can result in serious bodily injury, death, or property damage. Horses are unpredictable animals, and their behavior may be affected by numerous factors, including sounds, sudden movements, unfamiliar objects, other animals, terrain, weather, equipment, riders, handlers, and other circumstances.
Shared Saddle does not inspect, evaluate, test, supervise, or verify any horse, rider, owner, facility, equipment, listing, or arrangement offered or discussed through the Platform. Shared Saddle makes no representation or warranty regarding the health, soundness, temperament, training, experience, behavior, suitability, or safety of any horse or the qualifications, experience, or suitability of any user.
Users are solely responsible for conducting their own due diligence and determining whether a horse, rider, owner, facility, activity, or arrangement is appropriate and safe before participating in any equine activity. Users are encouraged to conduct in-person evaluations, obtain appropriate professional assistance when necessary, and use written agreements and liability releases appropriate to their circumstances.
By using the Platform, users acknowledge and understand that equine activities involve inherent risks and voluntarily assume the risks associated with participating in equine activities arising from connections or arrangements made through Shared Saddle.
Many states have enacted equine activity liability laws that may limit liability for certain injuries or damages resulting from the inherent risks of equine activities. The requirements, protections, exceptions, and required warning language under these laws vary by state. Users are responsible for understanding and complying with any equine activity liability laws, warning requirements, releases, insurance requirements, or other laws applicable to their activities and location.
Shared Saddle does not provide legal, veterinary, medical, training, or equine-safety advice and does not represent that use of the Platform, these Terms, or any agreement between users satisfies the requirements of any state or local equine activity liability law.
8. In-Person Meetings and Personal Safety
Shared Saddle facilitates online connections that may lead to in-person meetings.
Users are responsible for exercising reasonable judgment and appropriate safety precautions when communicating with or meeting another person.
Shared Saddle does not conduct background checks on every user unless explicitly stated otherwise and does not guarantee the identity, background, intentions, qualifications, or conduct of any user.
You are responsible for deciding what personal information you share and with whom.
9. Payments Between Users
Unless Shared Saddle expressly offers a specific payment service, payments associated with a private shareboard, lease, boarding arrangement, deposit, horse care, or other agreement between users are made independently of Shared Saddle.
Shared Saddle is not responsible for collecting, holding, refunding, guaranteeing, or resolving disputes regarding payments made directly between users.
Users should use appropriate caution before sending money to another person.
10. Shared Saddle Memberships and Fees
Shared Saddle may offer free and paid membership or listing options.
Features, prices, listing periods, limits, and benefits may vary and will be described on the Platform at the time of purchase or enrollment.
Paid features do not guarantee:
- A particular number of views or inquiries.
- Successful placement of a horse.
- A suitable rider or horse match.
- Any particular marketplace outcome.
Fees are charged according to the price displayed at checkout.
11. Listing and Membership Expiration
Certain listings, memberships, or paid features may remain active only for a specified period.
When a listing or membership expires, associated listings or features may become unavailable, unpublished, removed, or otherwise inaccessible.
Users should not rely on Shared Saddle as permanent storage for listing descriptions, photographs, videos, or other content.
Shared Saddle does not guarantee that expired or removed listing content will remain available for restoration or reuse. Users are encouraged to retain their own copies of listing descriptions, photographs, videos, and other important information.
If a listing must be recreated following expiration, the user is responsible for submitting a new listing and confirming that the information remains accurate.
12. Refunds and Cancellations
Unless otherwise stated at the time of purchase, payments for Premium memberships, listings, featured placement, or other digital marketplace services are generally non-refundable once the purchased service has been activated or made available.
Shared Saddle may, at its discretion, issue a refund or account credit when appropriate, including in cases involving duplicate charges or technical errors attributable to Shared Saddle.
Removing a listing, finding a rider or horse before the listing period ends, or choosing not to use the remaining portion of a paid service does not automatically entitle the user to a prorated refund.
Nothing in this section limits rights that cannot legally be waived under applicable law.
13. Prohibited Conduct
Users may not use Shared Saddle to:
- Post intentionally false, deceptive, or fraudulent information.
- Impersonate another person or organization.
- Harass, threaten, stalk, or abuse another user.
- Engage in unlawful discrimination or other unlawful conduct.
- Post content they do not have permission to use.
- Attempt to gain unauthorized access to accounts, systems, or data.
- Distribute malicious software or interfere with Platform operation.
- Use Shared Saddle for scams or fraudulent financial activity.
- Scrape, harvest, copy, or systematically collect Platform data without authorization.
- Use the Platform in a way that violates applicable law or these Terms.
14. Account and Listing Enforcement
Shared Saddle reserves the right to investigate suspected violations of these Terms.
We may remove listings, restrict features, suspend accounts, terminate accounts, or take other reasonable action when we believe it is necessary to protect users, the Platform, or Shared Saddle.
Serious safety, fraud, legal, or abuse concerns may result in immediate action.
15. Third-Party Services and Links
Shared Saddle may rely on or link to third-party services, including payment processors, mapping providers, hosting providers, and other technology services.
Shared Saddle does not control and is not responsible for the independent practices, availability, security, content, or policies of third-party services.
Your use of third-party services may also be subject to their own terms and privacy policies.
16. Intellectual Property
The Shared Saddle name, branding, logo, website design, original website content, and other materials created by Shared Saddle are owned by Shared Saddle or used with permission and may be protected by intellectual property laws.
You may not copy, reproduce, distribute, sell, or commercially exploit Shared Saddle’s proprietary materials without permission.
This section does not transfer ownership of user-submitted content to Shared Saddle.
17. Disclaimer of Warranties
To the fullest extent permitted by law, Shared Saddle is provided on an “as is” and “as available” basis.
We do not warrant that the Platform will always be available, uninterrupted, secure, error-free, or free from harmful components.
We make no warranty regarding the accuracy, reliability, safety, quality, or suitability of listings, users, horses, facilities, opportunities, or arrangements made through the Platform.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Shared Saddle and its owners, operators, affiliates, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Platform.
Shared Saddle is not responsible for injuries, death, property damage, financial loss, disputes, misrepresentations, accidents, horse-related incidents, or other losses arising from interactions or arrangements between users.
To the fullest extent permitted by law, Shared Saddle’s total liability for any claim relating to a paid service will not exceed the amount you paid directly to Shared Saddle for the service giving rise to the claim during the preceding twelve months.
Some jurisdictions do not allow certain limitations or exclusions of liability, so portions of this section may not apply to you.
19. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Shared Saddle and its owners, operators, affiliates, employees, contractors, and service providers from claims, damages, liabilities, losses, and reasonable expenses arising from or related to:
- Your use of Shared Saddle.
- Content you submit.
- Your violation of these Terms.
- Your violation of another person’s rights.
- A horse, riding activity, property, facility, or arrangement for which you are responsible.
- An agreement, transaction, dispute, or interaction between you and another user.
20. Changes to the Platform or These Terms
Shared Saddle may modify features, pricing, membership options, listing requirements, or other aspects of the Platform as the service develops.
We may also update these Terms periodically.
When we make changes, we will update the “Last Updated” date. Continued use of Shared Saddle after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
21. Governing Law
These Terms will be governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any legal proceeding arising from these Terms or use of Shared Saddle will be brought in a court of competent jurisdiction in Illinois, unless applicable law requires a different venue.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
23. Entire Agreement
These Terms, together with the Shared Saddle Privacy Policy and any additional terms presented for a particular service or purchase, constitute the agreement between you and Shared Saddle regarding use of the Platform.
